1. Who we are

FXfolio is operated by Asian Digital Mind LLC, a California limited liability company (“we”, “us”). These Terms govern your use of the FXfolio app, website and alerts (the “Service”). By creating an account or using the Service you agree to them. If you do not agree, do not use the Service.

2. What FXfolio does

FXfolio monitors trading accounts you connect and shows their balance, equity, margin, profit and loss, trade history and statistics. It sends the alerts you set up by push notification, email and, where available, other channels. FXfolio is read-only: it never places, changes or closes trades, and never moves money.

3. Your FXfolio account

• You must be at least 18 and able to enter a binding contract.
• You sign in with a one-time code sent to your email. Keep access to that email secure: anyone who controls it can sign in as you.
• Give accurate information and keep it up to date. You are responsible for activity under your account.

4. Connecting trading accounts

• You may connect only accounts you own or are authorised to monitor.
• Connect with your broker’s investor (read-only) password. Do not give us a master or trading password. If you do, you accept the risk, and we may disconnect the account.
• We store the password encrypted and use it only to log a terminal into your account and read its data. You can change it or remove the account at any time in the app.
• If a trading account sends no data for 90 days, we delete it with its history and stored password. We email you first, at 60 and 83 days, and reconnecting it in time keeps it. An account that was already inactive gets at least 30 days’ notice. Your FXfolio account isn’t affected.
• Your broker’s terms still apply to your account. Some brokers limit third-party access; checking that is your responsibility.
• FXfolio works with MetaTrader 4 and MetaTrader 5 accounts. MetaTrader is a trademark of MetaQuotes Ltd.; FXfolio is not affiliated with or endorsed by MetaQuotes or any broker.

5. Plans and limits

Each plan allows a set number of connected accounts and alert features, as shown in the app. We may change plans and limits; for a paid plan, changes take effect at your next billing period, with notice.

6. Payments

Paid plans are not on sale yet. Before we charge anything, we will publish the prices and the billing, cancellation and refund terms here, and tell you by email or in the app.

7. Acceptable use

You agree not to: use the Service unlawfully or to monitor accounts without authorisation; try to access other users’ data; probe, overload or disrupt our systems; reverse engineer the Service except where the law allows; or resell or share access without our written consent.

8. Not financial advice

FXfolio shows data and statistics about your own accounts. Nothing in the Service is investment, financial, tax or legal advice, or a recommendation to buy or sell anything. Trading foreign exchange and CFDs carries a high risk of loss. You alone are responsible for your trading decisions.

9. Alerts are best effort

Alerts depend on things outside our control: your trading terminal staying connected, your broker’s servers, internet links, Apple and other notification services, and your device settings. Alerts can be delayed, duplicated or missed, and figures can be stale or differ from your broker’s.

Do not rely on FXfolio as your only way to monitor margin, risk or positions. Always check your broker’s platform before acting.

10. Disclaimers and limitation of liability

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy of data. To the fullest extent the law allows, we are not liable for any trading losses, lost profits, or indirect, incidental, special or consequential damages, including losses from a missed, late or incorrect alert or figure. Our total liability for any claim is limited to the greater of the fees you paid us in the 12 months before the claim and US$100. Some jurisdictions do not allow these limits, so they may not fully apply to you.

11. Indemnity

You will indemnify us against claims arising from your breach of these Terms or from your use of accounts you were not authorised to connect.

12. Suspension and ending your use

You can stop using the Service and remove your accounts at any time in the app. We may suspend or end access if you breach these Terms, if the law requires it, or to protect the Service or other users, with notice where reasonable. Sections 8 to 11 and 14 continue to apply after your use ends.

13. Changes

We may update the Service and these Terms. For material changes we will give at least 14 days’ notice by email or in the app. Continuing to use the Service after a change takes effect means you accept it.

14. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Disputes go to the state or federal courts located in California, unless the law of your country of residence gives you the right to bring a claim locally.
